Artistic Research Methodology argues for artistic research as a context-aware and historical process that works inside-in, beginning and ending with acts committed within an artistic practice. An artistic researcher has three intertwined tasks. First, she needs to develop and perfect her own artistic skills, vision and conceptual thinking. This happens by developing a vocabulary for not only making but also writing and speaking about art. Second, an artistic researcher has to contribute to academia and the «invisible colleges» around the world by proposing an argument in the form of a thesis, a narrative; and in so doing helping to build a community of artistic research and the bodies of knowledge these communities rely on. Third, she must communicate with practicing artists and the larger public, performing what one could call «audience education». There is no way of being an engaged and committed partner in a community without taking sides, without getting entangled in issues of power. Consequently, the methodology of artistic research has to be responsive both to the requirements of the practice and the traditions of science. Here the embedded nature of the knowledge produced through artistic research becomes evident. Artistic Research Methodology is essential reading for university courses in art, art education, media and social sciences.

Boyhood to Manhood: Deconstructing Black Masculinity through a Life Span Continuum seeks to foster an open and honest discussion about the intersection of multiple identities found among Black males. The book explores topics such as what it means to be a Black male; race and ethnicity; health; [dis]ability; athletics; socioeconomic status; historical accounts; employment; religion and sexual identity. Many Black men share the experience of being members of cultures that are guided by strict gendered norms. These norms often require men to conform to «masculine» behaviors, which may increase their levels of risk-taking behavior, anxiety and fear of being ostracized should they fail to display the appropriate «male» skill sets. The ability to explore and embrace other possibilities for the ways that men can construct their personal and professional realities helps to enhance and broaden the ways in which men live their lives and seek opportunities. The qualitative, quantitative and historical data presented in this book provide new understandings of the experiences, roles and perspectives of Black men.

Die Grundidee des auf eine Tagung zum Thema «Hegels Konzept der Integration naturwissenschaftlicher Erkenntnis in ein System der Philosophie» zurückgehenden Bandes besteht darin, langjährige Bemühungen um Hegels Philosophie zusammenzuführen, unterschiedliche Traditionslinien der Interpretation der Hegelschen Philosophie in den Dialog zu bringen, insbesondere das Verhältnis einer philosophischen Analyse der modernen Naturwissenschaft zu Untersuchungen der begriffslogischen Bestimmtheit des Hegelschen Systems zu debattieren. Es soll gezeigt werden, daß weder eine moderne Naturphilosophie ohne kritisch-konstruktive Rezeption der Hegelschen Naturphilosophie entwickelt werden noch das Hegelsche System ohne gewissenhafte Analyse seiner Naturphilosophie begriffen werden kann.

Poems 2000-2005 is a transitional collection written while the author - also known to be W. J. Me Cormack, literary historian - was in the process of moving back from London to settle in rural Ireland. It is also a vigorous contribution to the age-old dialogue between Sacred and Profane themes, questioning beliefs and pleasures, guilts and landscapes, poetic methods and prosaic realities.

Sich heute mit Religion in Militär und Gesellschaft zu beschäftigen, ist nicht neu, aber - spätestens seit dem 11. September - aktueller denn je. Einerseits ist von einer Renaissance des Religiösen, sogar von der postsäkularen Gesellschaft die Rede, andererseits sind die Kirchen mit Problemen wie Bedeutungs- und Mitgliederschwund, Glaubensverlust und Sinnkrise konfrontiert. Aufschwung des Religiösen und Niedergang der Kirchen sind also die beiden Pole, zwischen denen das Verhältnis von Religion und Gesellschaft, von Kirchen und Staat in Deutschland wie insgesamt in der Welt zu verorten ist. Die Beiträge der Autoren sind in diesem Spektrum angesiedelt. The Irish songwriter, Thomas Moore (1779-1852) enjoyed enormous popularity during and after his lifetime and his celebrity was summed up by his friend, Lord Byron, who declared him: «The poet of all circles and the idol of his own». Yet, despite his seminal role in the development of Irish national song, few modern editions have been made available and none focus on the earliest piano arrangements published during Moore¿s lifetime and the decades following his death. This new critical edition collects together for the first time in one volume selected original arrangements of the world-famous Irish Melodies for solo voice and duet along with other successful English-language songs to texts by Moore and foreign-language settings by Schumann, Mendelssohn, Berlioz and Duparc. Several aspects were considered in choosing songs such as their historical significance as well as their usefulness to the performer and impact in performance and the beauty of the vocal content and the partnering accompaniments. This collection of essays on Francis Bacon (1909-1992) pays tribute to the legacy, influence and power of his art. The volume widens the relevance of Bacon in the twenty-first century and looks at new ways of thinking about or reframing him. The contributors consider the interdisciplinary scope of Bacon's work, which addresses issues in architecture, continental philosophy, critical theory, gender studies and the sociology of the body, among others. Bacon's work is also considered in relation to other artists, philosophers and writers who share similar concerns. The innovation of the volume lies in this move away from both an art historical framework and a focus on the artist's biographical details, in order to concentrate on new perspectives, such as how current scholars in different disciplines consider Bacon, what his relevance is to a contemporary audience, and the wider themes and issues that are raised by his work.

Die Arbeit beschäftigt sich rechtsvergleichend mit dem Factoring in Deutschland und Frankreich. Die Rechtsinstitute, die das französische Recht für den Forderungsübergang bereit hält, werden umfassend dargestellt. Untersucht wird darüber hinaus das deutsch-französische Factoring im Rahmen des EVÜ. Ausgehend von der Analyse der kollisionsrechtlichen Behandlung erfolgt daraufhin eine Darstellung international-rechtlicher Harmonisierungsakte. Es wird des Weiteren der Frage nachgegangen, ob das UNIDROIT-Übereinkommen über das internationale Factoring das grenzüberschreitende Factoring im deutsch-französischen Verhältnis erleichtert und wie das Verhältnis zu der neuen UNCITRAL-Konvention über Forderungsabtretungen im internationalen Handel ist.

The revolutions of 1789 and 1917 were defining moments for religious history in France, Russia, and even in Europe as a whole. Drawing on the self-portrayals of some of the most radical actors, historians have presented revolutionaries as enemies of the church, and men of the church either as counter-revolutionaries or as victims of revolution. Revolution and religion have appeared as antagonistic forces, representing the struggle of modernity against tradition. Only recently have these conventional patterns of interpretation been questioned. Historians explore the religious origins of revolutions, look at clergymen and churches as revolutionary actors and analyze how revolutionary movements appropriate religious patterns of thought and behavior. In the French and in the Russian context, revolutions are seen as moments in which the sacred was redefined.

Das Schweizerische Jahrbuch für Kirchenrecht bzw. Annuaire suisse de droit ecclésial befasst sich mit der ganzen Breite des Kirchenrechts, angefangen mit dem Recht der evangelisch-reformierten Kirchen sowie der römisch-katholischen Kirche und ihrer Kantonalkirchen, sodann dem Staatskirchenrecht, d.h. denjenigen staatlichen Rechtssätzen, die Religion und Kirche betreffen, und bezieht auch religionsrechtliche Fragestellungen ein, die sich aus der zunehmenden Bedeutung ausserchristlicher Religionen in der Schweiz ergeben. In seinem Aufsatzteil enthält das Jahrbuch u.a. die Vorträge, die auf den Jahrestagungen der Schweizerischen Vereinigung für evangelisches Kirchenrecht gehalten werden. Berichte aus Kirchen und Kantonen geben die Entwicklung des Kirchenrechts in den Regionen und Landesteilen wieder und machen auf wichtige Ereignisse aufmerksam. Ferner werden neuergangene und partial- bzw. totalrevidierte Kirchenverfassungen, religionsrechtliche Bestimmungen staatlicher Verfassungen sowie kantonale Kirchengesetze durch Abdruck dokumentiert und wichtige kirchenrechtliche Neuerscheinungen rezensiert. Der Sammelband beschäftigt sich mit den komplexen völkerrechtlichen und europarechtlichen Fragen der Sicherheit und des internationalen Terrorismus. Da das bisherige Völkerrecht für private terroristische Tätigkeiten noch keine ausreichenden Regeln ausgebildet hat, wird mit der Publikation in vielen Bereichen wissenschaftliches Neuland betreten. The Gothic Language: Grammar, Genetic Provenance and Typology, Readings, now in its second edition, is designed for students and scholars of the oldest known language with a sizeable corpus, belonging to the English, German, Dutch, and Scandinavian language clade. The Gothic language is seminal to the history of the study of each of these languages. Gothic grammar is a standard text in courses on Indo-European and general linguistics since Gothic serves as the prototype Germanic language in the study of historical comparative world language typologies. Particularly pan-Germanic is the innermost core of the grammar, the genetic phonology, which is reconstructed within the most recent approaches of laryngeal and glottalic theories. Most challenging to traditional viewpoints is the total novel restructuring of Gothic synchronic phonology via current theoretical approaches such as underspecification theory and optimality theory. While the Gothic inflectional morphology is rendered in full paradigmatic display, its understanding is enhanced by the application of underspecification theory and the use of inheritance networks, a computational linguistic concept. Brief "Syntactic Considerations" concluding the grammar present a network of head-driven phrase structures. This book also brings the reader into the ambience of the fourth-century Goths. The issues of violence and its control, containment or overcoming range prominently in the social sciences. Empirical sociology seeks to derive generalizable explanations from its research into concrete cases of the occurrence or absence of violent conflict, aspiring to transform such explanations into instructions for strategic action. Within cultural studies, discursive and epistemic formations are assumed to be fundamentally and endemically violent. In these perspectives, the quotidian violence that ineluctably inheres in modern discourses manifests itself as, e.g., normalisation, privilege and exclusion, thus sharing a wide range of common objects and objectives with the social sciences. The essays collected in this volume address contemporary conjunctures and discourses of violence in world society from different disciplines ranging from cultural studies, social science, political science and philosophy to history, literary criticism and psychology.

Why do revivals and adaptations of Greek tragedy still abound in European national theatres, fringe stages and international festivals in the twenty-first century? Taking as its starting point the concepts of myth developed by Jean-Luc Nancy and Roland Barthes and the notion of the ¿classical¿ outlined by Salvatore Settis, this book analyses discourses around community, democracy, origin and Western identity in stage adaptations of Greek tragedy on contemporary European stages. The author addresses the ways in which the theatre produces and perpetuates the myth of ¿classical¿ Greece as the origin of Europe and how this narrative raises issues concerning the possibility of a transnational European community. During the last decade studies have indicated that migration has been a normal, structural element of human societies throughout history. Progress in migration and settlement studies under this new paradigm has been so substantial that a new state of the art is needed. This book presents a reconsideration of current theoretical perspectives encompassing enlightened insights in diverging specialisms in the field of migration history, such as slavery studies, ethnic history, macro-economic migration studies, and gypsy studies. Um sich im Wettbewerb behaupten zu können, nehmen Innovationen auch im Versicherungsbereich einen immer höheren Stellenwert ein. Entsprechend hat derjenige, der neue Versicherungsprodukte entwickelt, ein ureigenes Interesse an einem Schutz gegen Nachahmung, um auf diese Weise seinen Wettbewerbsvorsprung zu erhöhen. Für den technischen, gewerblichen Bereich stehen zahlreiche Instrumente zum Innovationsschutz bereit. Demgegenüber gewähren Patentrecht, Urheberrecht, Markenrecht und Wettbewerbsrecht für Versicherungsdienstleistungen nur einen unzureichenden Schutz. Dabei zeigt sich bei einer näheren Betrachtung der Rechtfertigungsgründe des gewerblichen und geistigen Sonderrechtsschutzes, dass ein Schutz innovativer Dienstleistungen sowohl aufgrund ihrer gesamtwirtschaftlichen Bedeutung als auch aus der bestehenden Dogmatik heraus gerechtfertigt wäre.

Ausgehend von vier Texten aus den Amores und Metamorphoses wird zu Problemen der jüngeren Ovidforschung Stellung genommen: Welche Beziehungen gibt es zwischen Kunstwerksbeschreibungen und der Haupterzählung? Wie nutzt der Dichter Kunstwerksbeschreibungen zur indirekten Charakterisierung seiner eigenen Kunst? In welchem Maße ist das Verwandlungsmotiv auch außerhalb der eigentlichen Schlußverwandlungen in den Metamorphoses wirksam? Wie läßt sich das Verhältnis von Verwandlung und Identität angemessen beschreiben?

1877 wurde im Deutschen Reichstag das Reichspatentgesetz verabschiedet. Es legte die Rechtsgrundlage für die Entwicklung eines modernen Erfindungsschutzes und erwies sich als zukunftsorientiert, da es die zunehmende Industrialisierung des Erfindens voraussah. Zugleich beförderte das Reichspatentgesetz die Herausbildung einer spezifischen deutschen Technologiekultur. Das Buch dokumentiert eine wissenschaftliche Tagung aus Anlaß des 120-jährigen Jubiläums dieses Gesetzeswerks. Diese widmet sich erstmals dem Patentwesen in den verschiedenen Facetten seiner Bedeutung etwa als Indikator, aber auch Initiator technischer Innovation, als Ausdruck staatlicher Wirtschaftspolitik und nationaler Technikkultur, sowohl in historischer als auch in gegenwartsbezogener Perspektive.

Die Zulässigkeit von Personalauswahlverfahren wird üblicherweise unter persönlichkeitsrechtlichen Aspekten diskutiert. Der Verfasser arbeitet das Themengebiet deshalb konsequent von den verfassungsrechtlichen Grundlagen her auf. Dies versetzt ihn in die Lage, die kaum mehr überschaubare Quellenvielfalt in Literatur und Rechtsprechung Stück für Stück zu ordnen und die geltende Rechtslage in sämtlichen Einzelaspekten detailliert herauszuarbeiten. Dabei wird die herrschende Lehre in vielen Punkten kritisch hinterfragt, bleibt jedoch als Orientierungspunkt stets erkennbar. Karel van Manders Schilder-Boeck von 1604 ist eine der komplexesten kunsthistoriographischen und kunsttheoretischen Quellenschriften zur Malerei der Frühen Neuzeit. Angesichts der theoretischen Gewichtung sind dem Schilder-Boeck maltechnische Inhalte bislang konsequent abgesprochen worden. Die Vielzahl der in den Lebensbeschreibungen und im Lehrgedicht abgelagerten technischen Hinweise lässt jedoch auch eine auf die Malpraxis bezogene Lesart des Textes zu. Denn gerade durch die Einbeziehung von produktionsrelevanten Aspekten vermag van Mander zwei wesentliche Intentionen seiner Theoriediskussion argumentativ zu stützen: Die Widerlegung der von Vasari beanspruchten kulturellen Autorität der italienischen Malerei und die Formulierung eines demonstrativen Protests gegen das einengende, jeglichen künstlerischen Fortschritt hemmende Regelwerk der niederländischen Zünfte.

Mit der Reform der freiwilligen Gerichtsbarkeit im Jahre 2009 sollten Unklarheiten beseitigt werden und eine Angleichung an andere Verfahrensordnungen erfolgen. Trotz dieser Anstrengungen ergeben sich nach wie vor in einzelnen Bereichen noch Zweifelsfragen. Diskussionen bestehen insbesondere im Hinblick auf die materielle Rechtskraft, die außerordentlichen Rechtsbehelfe sowie die Wiederaufnahme. Ziel dieser Arbeit ist es, auf diesen Gebieten Lösungsansätze aufzuzeigen.

Die erste deutsche Republik sah sich vor eine historische Aufgabe gestellt, auf die sie nicht vorbereitet war: Um den Eintritt Deutschlands in die europäische politische Modernität zu leisten, mußte sie mit dem Historismus und mit dem Mythos des deutschen Sonderwegs abrechnen, der in allen Schichten und ideologischen Strömungen tief verankert war und Deutschlands Geschichtsbewußtsein und nationale Identität beherrschte. Der Band setzt sich zum Ziel, (1) die Ursprünge des Sonderweg-Gedankens und insbesondere seinen Zusammenhang mit dem Historismus zu erforschen; (2) seine Funktion in den politischen und philosophischen Diskursen der Mobilmachung (den «Ideen von 1914») zu untersuchen; (3) sein Fortleben in den politisch-philosophischen Konzepten der Republik zu hinterfragen; (4) seine grundlegende Bedeutung für die Auffassungen der «europäischen Schicksalsgemeinschaft» dazulegen; (5) eine Reflexion über das Fortwirken des Sonderweg-Gedankens in der deutschen Historiographie sowie in der politischen Kultur der Nachkriegszeit insgesamt - vor allem dort, wo es um Deutschlands Stellung in Europa geht - anzubahnen.

Die Festschrift ehrt Christoph Koch, Professor für Vergleichende und Indogermanische Sprachwissenschaft an der Freien Universität Berlin. Zu seinem 80. Geburtstag vereint der Band wissenschaftliche und persönliche Beiträge von Kollegen, Schülern und Freunden. I contributi a questo volume trattano della relazione fra lingua e nuovi media. Da un lato certi cambi linguistici recenti sono il risultato dell'introduzione di nuovi media, e dall'altro molte risorse linguistiche, tanto primarie quanto secondarie, sono ormai disponibili in forma elettronica. I nuovi media si analizzano dunque tanto come catalizzatori del cambio linguistico quanto come strumenti per la ricerca linguistica.

Diese Studie hat das Testamentsrecht des Vorderen Orients in Vergangenheit und Gegenwart am Beispiel Ägyptens zum Gegenstand. Erb- und Familienrecht bilden den Kern des traditionellen islamischen Rechts. Das ägyptische Testamentsgesetz stellt die erste neuzeitliche Kodifikation dieses Rechtsbereichs dar und hat dem Gesetzgeber in einigen weiteren Ländern der Region als Vorbild gedient. In der Untersuchung wird analysiert, inwieweit die heutige Gesetzgebung auf den Grundsätzen des klassischen, im Koran enthaltenen Rechts beruht bzw. davon abweicht. Als Referenz werden die Ausführungen im Kompendium des al-Kasani, eines Juristen des 12. Jahrhunderts, herangezogen. Die Arbeit schließt mit einer Übersetzung des ägyptischen Testamentsgesetzes von 1946 ins Deutsche.

Les recherches réunies dans ce livre partent du constat que le Moyen Âge ne connaissait pas notre notion d'' objet '. Le mot n'a en effet pris son sens courant de chose de dimension limitée, destinée à un certain usage, que vers la fin du XVIII siècle. Comment peut-on, dès lors, rendre compte sans anachronisme de ce que les ' objets ' ont été pour ceux qui vécurent durant les siècles précédents ? La figure de Charlemagne a permis aux auteurs d'aborder cette question à partir de deux phénomènes historiques. Das deutsche Recht sieht mit dem Pflichtteil eine bedarfsunabhängige Mindestbeteiligung am Erbe für Kinder, Ehepartner und Eltern vor. Im Gegensatz dazu gewährt des englische Recht Hinterbliebenen ermessensabhängige Ansprüche (family provision), die sich insbesondere nach der Bedürftigkeit richten. Die gesetzlichen Vorgaben beider Länder können jedoch jeweils nur allgemein die Interessen einzelner Familienangehöriger gegeneinander abwägen. In vielen Fällen ist daher eine vertragliche Ausgestaltung gewünscht. Gleichzeitig stellt sich bei Verträgen im familiären Kontext auch die Frage, wie eine in einer Nähebeziehung entstehende Verhandlungsdisparität rechtlich zu bewerten ist. Für Eheverträge hat die deutsche Rechtsprechung eine richterliche Inhalts- und Ausübungskontrolle im Rahmen der §§ 138 und 242 BGB entwickelt. Es wird nun diskutiert, ob dies auch auf den Pflichtteilsverzicht übertragbar ist.

Fascist and colonial legacies have been determinant in shaping how Italian colonialism has been narrated in Italy till the late 1960s. This book deals with the complex problem of public memory and discursive amnesia.
The detailed research that underpins this book makes it no longer possible to claim that after 1945 there was an absolute and traumatic silence concerning Italy's colonial occupation of North and East Africa. However, the abiding public use of this history confirms the existence of an extremely selective and codified memory of that past.
The author shows that colonial discourse persisted in historiography, newspapers, newsreels and film. Popular culture appears intertwined with political and economic interests and the power inscribed in elite and scientific knowledge. While readdressing the often mistaken historical time line that ignores that actual Italian colonial ties did not end with the fall of Fascism, but in 1960 with Somalia becoming independent, this book suggests that a new post Fascist Italian identity was the crucial issue in reappraisals of a national colonial past.

This volume collects papers put together by an interdisciplinary group of scholars, which explore how the two imaginary geo-cultural spaces «Central Europe» and «(North) America» have mutually attributed meanings to each other over the past two centuries, how traveling images of an «othered» cultural space - inserted into specific regional, national and social contexts and appropriated for negotiations of cultural identity and belonging as well as exclusion and colonization - have laid the basis for a cultural essentialism which thinks culture through space and negotiates cultural status through de-historicized notions of place and territory. It particularly focuses on processes of motion and travel which helped to create these images and discusses in individual case studies a wide variety of cultural phenomena - ranging from music to film, from tourism to world fairs - while sharing the common concern to explore how motion through space - whether physical or imaginary - helped shape, crystallize and negotiate images of the cultural other in contact or transit zones where people, images and cultures meet in asymmetrical relations of domination and subordination, and where tourists, exiles, travelers, displaced commodities and foreign cultural practices generate powerful, as well as potentially subversive, visions and imaginings. Thus this volume invites to find individual paths and ports in/between the subjects presented and in a way to contribute to, to follow up the web of exchange represented by its authors, themselves a (mostly) virtual community of researchers.

Over the last two decades scholars and citizens in Central and Eastern Europe had more than enough opportunity to realise that neither democracy nor the rule of law can be taken for granted. Such a realisation also means that if they want to think and speak clearly about or take a stand for their political and legal ideals, they need to reflect on them constantly, and conceptualise them in novel ways, by questioning entrenched lines of argument and problematising established patterns of thought. The contributors of this volume discuss a wide range of subjects from jurisprudential methodology and legal reasoning through democracy and constitutional courts to rights and criminal justice, raising questions and suggesting new ideas on «The Rule of Law and the Challenges to Jurisprudence» in Central and Eastern Europe and beyond.

Research into the relationship between conversation analysis (CA) and different areas of applied linguistics is increasing rapidly. The aim of this volume is to show how conversation analysis can make a significant contribution to the teaching of spoken language for specific purposes (LSP) and to provide a firm foundation for future research and practice in this area. The first-ever collection in this area, the volume provides a theoretical and methodological framework for applying CA to LSP, as well as a series of illustrations of practical applications of CA in specific domains including interpreting, journalism, service encounters, academic discourse and the language classroom. The chapters in this collection are all written by CA practitioners with experience in the teaching of language for specific purposes and will appeal to researchers and students in applied linguistics and the social sciences, particularly those working in LSP teaching and teacher training.

Das Europäische Parlament ist die weltweit einzige übernationale Institution, die von den Bürgern direkt gewählt wird. Aufgrund dieser Legitimation wurden ihm in den letzten Jahren stetig neue Aufgabenfelder anvertraut. Zur Bewältigung dieser neuen Aufgaben ist es für das Parlament unerlässlich, dass es die inneren Strukturen besitzt, um weiter handlungsfähig zu bleiben. Diese Untersuchung befasst sich daher mit dem Funktionsrecht des Europäischen Parlaments, d.h. allen Normen, die das Handeln des Europäischen Parlaments zum Zwecke der Verwirklichung der Vertragsziele näher bestimmen. Die Arbeit setzt sich mit den bestehenden Normen des Funktionsrechts kritisch auseinander und untersucht, welche Reformen aus rechtspolitischer Sicht für die Zukunft angestrebt werden müssen.

Les événements de Mai 1968 sont considérés comme une césure sociale et culturelle dans l'histoire contemporaine de la France. Débutant par une révolte étudiante à Nanterre et Paris, un mouvement de protestation politique s'ensuivit qui faillit provoquer la chute du président de Gaulle et de la 5e République. Le but de l'anthologie critique présentée est de donner une idée assez riche de ce mouvement multiforme avec un choix de textes et d'illustrations expliqués et annotés par des commentaires détaillés. La connaissance historique de cette brèche culturelle survenue en 1968 nous paraît indispensable pour comprendre la France contemporaine. En outre, ces événements aident à éclaircir les motivations, idéals et utopies ressentis et formulés par les mouvements de contestation de la jeunesse européenne toute entière, à la fin des années soixante.

Die Problematik des Arbeitnehmerschutzes bei Aufhebungsverträgen stellt sich nicht zuletzt durch die Schuldrechtsreform aktueller dar als je zuvor. In einer umfassenden Untersuchung wird ein Mittelweg zwischen effektivem Arbeitnehmerschutz und übermäßiger Arbeitgeberbelastung aufgezeigt. Der Schwerpunkt liegt auf der Frage nach einem Widerrufsrecht gemäß §§ 312, 355 BGB und dabei vor allem auf der Verbrauchereigenschaft des Arbeitnehmers. Hierzu wird ein eigenes Lösungskonzept entworfen. Daneben werden insbesondere ein völlig neues Modell zur Ermittlung von Aufklärungspflichten entwickelt und die Widerrechtlichkeit einer Kündigungsandrohung bei der Anfechtung neu bestimmt. Zur AGB-Kontrolle wird nachgewiesen, dass diese nur bei Nebenleistungen möglich ist, wobei tarifvertragliche Regelungen als flexibler Maßstab dienen können. Neben vielem mehr runden die Darstellungen der sozialversicherungs- und verfassungsrechtlichen Determinanten sowie rechtsvergleichende und rechtspolitische Überlegungen die Arbeit ab. Damit liefert sie nicht nur für den arbeitsrechtlichen, sondern auch für den zivilrechtlichen und den verfassungsrechtlichen Diskurs einen weiteren Anstoß.

The films of Aki and Mika Kaurismäki are part of a globalising Finnish cinema, challenging conventional parameters at every turn. This work examines the films that the Kaurismäkis produced, individually and in collaboration, between 1981 and 1995 ¿ films which mobilise various methods to reflect, criticise, counteract and contribute to the globalisation of Finnish society in the era of late capitalist development. This work provides an in-depth analysis of these films, exploring the aesthetic and narrative content of the films as well as their production and reception in Finland. The theoretical scope of the work situates the films not only in the field of transnational cinema, but also that of ¿post-national¿ cinema. Exploring the Kaurismäkis¿ films in a post-national framework points to new, emergent understandings of both the fragility and the persistence of national culture and identity in a globalising world.

Diesem Thema war im September 2001 eine internationale Tagung in Wien gewidmet, deren Ergebnisse nun vorliegen. Der Stellenwert der Geschichte ist im östlichen Europa auch heute noch erheblich höher als in den Ländern Westeuropas, weil ihr die Aufgabe der Legitimation der neuen Staaten und Nationen zufiel, mit allen daraus resultierenden Gefahren, etwa dem Aufbau von Feindbildern. Behandelt werden Themen wie Kontinuität und Wandel der Institutionen und Personen der Geschichtsforschung, ihre internationale Vernetzung, das Verhältnis von Politik und Geschichte, neue methodische Ansätze, die Erschließung neuer Quellen, unterschiedliche Erinnerungsweisen, spezifische Kontroversen und Forschungsdefizite. Die Länderbeiträge der Wissenschaftler aus dem östlichen Europa werden durch Korreferate von Kollegen aus Deutschland und Österreich kritisch ergänzt.

This book focuses on the most recent methodological developments and views in the field of foreign language teaching with issues concerning mainly the foreign language teacher. Its aim is to lead teachers to a better understanding of their own assets, beliefs, and values, and to help them to improve their competencies. It deals with both the methodological and language preparation of teachers in order to give them a deeper understanding of the process of teaching and learning languages at the primary level. The first part of the book presents several papers about different methodological issues, linking theory and practice. The education of the teacher from a linguistic and a methodological point of view is the main focus. The next section of the book deals with research in language teaching, teacher education, and language. Finally the last section brings together four papers dealing with classroom teaching and the role of observation in teacher education. Effective Foreign Language Teaching at the Primary Level is of interest to teachers, teacher trainers and student teachers as it analyses important questions such as the nature of language teaching, the specific skills needed, the creation of an appropriate environment for teaching, and the use of materials and resources. Teachers can find both theoretical reflections and practical suggestions for the classroom by experts from several countries in the light of most recent research and thinking.

The central issues in recent economic and historical research and debates on the emergence of a global economy are: How and when did the development of an economic world system start? What were the essential economic, social or cultural factors which contributed to the emergence of a world-encompassing commercial network? The book examines the expansion of commercial activities since the seventeenth century by analysing the various facets of commercial networking and their linkages at three different operational levels and for various countries and regions. The first part focuses on the emergence, decline and reconstruction of whole networks. The second part provides an actor-centered approach highlighting the role of actors, agencies and institutions in the networking process, while the third one explores the role of commercial cities as merger of global and local functions. The essays provide an innovative approach as they elaborate the interplay between different levels of the emerging world economy. The contributions to this book were originally delivered at a conference organized in Düsseldorf, 07-09 March 2002. The selected essays in this volume offer an international and interdisciplinary approach to the complex and multi-layered process of the expansion of the economic world system.

Am 24. Oktober 1945 trat die Charta der Vereinten Nationen in Kraft. Die damals auf dem Hintergrund der Leiderfahrungen des Zweiten Weltkrieges festgeschriebenen Ziele haben auch heute in einer Zeit der beschleunigten Globalisierung und massiver Weltprobleme nichts an Aktualität eingebüßt. Nach sechs Jahrzehnten ihres Bestehens kann die UNO auf Erfolge zurückblicken; sie muss aber auch Misserfolge eingestehen. Neue Aufgaben sind im Laufe der Zeit hinzugekommen. Gleichzeitig offenbart sich in verschiedenen Bereichen Reformbedarf. Wie sieht die Bilanz der Vereinten Nationen im Hinblick auf Friedenssicherung, Menschenrechtsschutz und Internationale Strafgerichtsbarkeit aus? Welche Reformperspektiven ergeben sich? Und welche Rolle könnten die Vereinten Nationen künftig in der Weltgesellschaft spielen? Diesen und weiteren Fragen wird im vorliegenden Sammelband aus der Perspektive verschiedener Disziplinen nachgegangen.

The aim of the present book is to examine the social and cultural diversity of language teacher education, providing a unified account of highly diversified teacher development and appraisal realities across sociocultural contexts. We will strive to make an overview of a wide range of issues related to teacher development approaches and models, teacher competences, adopted roles, stressors and motivators, teacher appraisal systems, professional examinations and certifications as well as digital opportunities for teacher development. All of these concepts will be discussed in a wide social and cultural context, trying to bring examples from numerous countries.

In diesem Dokumentationsband der 4. Ökumenischen Sommerakademie wird die provokante Alternative «Gottesstaat oder Staat ohne Gott» zugunsten rechtsstaatlicher Modelle aufgebrochen, in denen es unter den Bedingungen der Religionsfreiheit keine radikale Trennung, wohl aber eine klare Unterscheidung von religiöser und politischer Sphäre gibt. Die komplementären Problemzugänge staatsrechtlicher, systematischer, historischer, religionssoziologischer und kulturphilosophischer Wissenschaft von Repräsentanten der drei abrahamitischen Religionen zeigen, dass im Blick auf gesellschaftliche Entwicklungen nicht bloß in Europa eine größere Sensibilität für religiös begründete Überzeugungen erforderlich ist. Gleichzeitig erweist sich ein intensiver theologischer Informationsaustausch im aufmerksamen Gespräch miteinander und nicht nur übereinander als notwendig.

Este volumen recoge una selección de las comunicaciones presentadas en el Congreso Internacional sobre Descortesía y violencia verbal en español, organizado por el Grupo de investigación «Argumentación y persuasión en Lingüística» en la Universidad de Sevilla durante los días 5 al 7 de noviembre de 2008. Los estudios aquí presentados se caracterizan, pues, por describir en diferentes corpora cómo el lenguaje se utiliza para crear una relación social armónica, o, por el contrario, para producir un choque frontal con el receptor o dañar su imagen. En ellos se abordan las diferentes normas que cada grupo social, situación interactiva o tipo de texto impone. De esta manera, hay aportaciones sobre sus manifestaciones en la sintaxis, la prosodia o la semántica que se basan en la lengua de los medios de comunicación, en interacciones orales en ámbitos coloquiales o formales como, por ejemplo, los debates parlamentarios, y en discursos del español peninsular y americano. El rigor científico presente en todos ellos hace que sus conclusiones supongan un verdadero avance en el diseño de las relaciones entre lenguaje y sociedad.

Los estudios sobre sintaxis han extendido su foco de interés al discurso en las últimas décadas.El presente trabajo se acerca desde la macrosintaxis a la descripción de elementos que aseguran la contextualización del mensaje en el marco comunicativo en el que se produce. Los operadores discursivos constituyen el paradigm del sistema que acoge la referencia a esta macroestructura. Las construcciones semilibres también desarrollan contenidos procedimentales para asegurar el anclaje en la enunciación y modalidad, expresión directa de la subjetividad del hablante, o en las referencias a la estructuración informativa y argumentativa que este realiza para orientar la interpretación. Los autores se acercan desde un enfoque lingüístico-pragmático a la descripción de estas formas en español.

Esito del 2° convegno della serie «E pluribus unum? L¿Italia dalla frammentazione preromana all¿unità augustea», tenutosi a Roma nel 2014, il libro tratta la «romanizzazione» dell¿Italia preromana, affrontando le dinamiche socio-politiche e linguistico-epigrafiche, le strutture economiche e del territorio, l¿integrazione religiosa e le produzioni artistiche e artigianali. Alla base del progetto c¿era l¿idea di portare storici, archeologi, linguisti e specialisti di letteratura latina a collaborare per costruire insieme su questi argomenti un quadro dalle tinte a volte significativamente contrastanti. Il dibattito sulla «romanizzazione» è stato uno dei più intensi nel panorama scientifico degli ultimi decenni. Del concetto sono stati declinati tutti i possibili punti di vista, tutte le criticità, le debolezze. Nel presente volume, il focus è stato dettato da un voluto understatement. Si è scelto di accettare l¿uso dell¿etichetta «romanizzazione», che infatti già dal titolo è stata posta tra virgolette, lasciando che i vari intervenuti fossero liberi di ridefinirla a loro piacimento. L¿idea è stata poi quella di articolare il tema in una serie di tavole rotonde, ciascuna incentrata su tematiche specifiche, caratterizzanti del fenomeno «romanizzatorio»: le dinamiche di integrazione e opposizione alla conquista dai punti di vista politico e istituzionale, le influenze reciproche a cui le diverse lingue e culture epigrafiche sono state soggette, le strutture economiche e del territorio, l¿integrazione religiosa e le produzioni artistiche e artigianali sono stati gli argomenti portanti del colloquio. Attorno a queste tavole rotonde, ciascuna coordinata da un discussant, si è cercato ancora una volta di radunare studiosi di formazione e classi di età diverse, alcuni più interessati alle realtà preromane e altri i cui interessi sono invece rivolti al mondo romano, nel tentativo di creare in questo modo ancora una volta il confronto dialogico tra diversi punti di vista.

«Re-Engineering» Dual Training - The Malaysian Experience shows how a new industrial country is successfully pursuing the aim to ensure the extremely swift increase of economic development by initiatives and concepts for the qualification of skilled workers. This publication reflects the analysis of best practice in training which centers around the workplace in lead countries as well as the philosophy, policies and procedures of the emerging Malaysian National Dual Training System. Excellence in high-tech work must be based on excellence in training. Training based on targeting specific competencies was seen as a way to achieve this excellence. However, this apparently logical approach, which seemed to make it the panacea for meeting today's pressing high-tech training needs, has failed to keep its promise. Yet, its undisputable contribution to the development of highly effective training has been to create awareness that the necessary accountability of training can only be secured through the definition of occupational standards. However, when they only reflect the immediate work which has to be carried out at the workplace, occupational standards seemingly fall short. The rapidly changing context of work also needs to be reflected, and therefore a new focus on the workprocess is needed to guide the necessary reorientation in training.

How can it be ensured that vocational education matches the requirements of the increasingly complex world of work? In search of a suitable approach, it has become evident that Competence-Based Training cannot provide this service since it focuses on static "work" instead of encompassing dynamic "work-processes." Consequently it is necessary to rely on the analysis of work-processes when designing a detailed curriculum for a digitalized environment and Industry 4.0. The results of the work-process analyses reflect the spectrum of requirements and are applied as the core elements for the shaping of detailed curricula. This ensures a state of the art of curricula and facilitates their swift development in matching changes in the world of work.

Der Zusammenhang von Facharbeit und beruflicher Bildung ist ein gesellschaftlich äußerst relevanter Problembereich, der in Deutschland noch immer über die Hälfte eines Altersjahrgangs berührt. In diesem Problembereich enthalten sind folgende Fragen: Welche Entwicklungen vollziehen sich in der Arbeitswelt? Sind diese Entwicklungen absehbar? Wie entwickeln sich die Qualifikationsanforderungen für die Fachkräfte? Mit welchen Konzepten wird dem Wandel der Arbeitswelt in der Berufsbildung begegnet? Und wie vollzieht sich in dem damit aufgespannten Rahmen die Aneignung von Kompetenzen durch Auszubildende und Facharbeiter? Dieses Buch nimmt diese unterschiedlichen methodischen Positionen in den Blick und macht sie für die Berufsbildungsforschung fruchtbar. Die Vorschriften zur körperschaftsteuerlichen Organschaft sind bereits seit Jahrzehnten Gegenstand eines wissenschaftlichen Diskurses. Der breiten Kritik an den geltenden Vorschriften wollte der Gesetzgeber zuletzt durch die Organschaftsreform aus dem Jahr 2013 entgegenwirken. Gegenüber dem Organschaftsregime, das auf dem Grundsatz der Trennung der beteiligten Gesellschaften fußt, behandeln die Vorschriften der fiscale eenheid in den Niederlanden die Konzernunternehmen als eine Einheit. Der Autor geht der Frage nach, welche Auswirkungen die Anwendung einer Einheitstheorie auf die tatsächliche Ausgestaltung der Gruppenbesteuerung entfaltet. Daneben entwickelt er einen Vorschlag zur grenzüberschreitenden Öffnung des Anwendungsbereiches der Organschaft über bilaterale Verträge.

This book investigates possible common objects of inquiry in philosophy of language and literature.
